1. Scope and Acceptance of the Terms and Conditions

1.1 These general terms and conditions (the “Terms and Conditions”) apply to and govern: (i) the access to, browsing, and use of the website available at www.naturalresistance.com (the “Website”); and (ii) the purchase, delivery, and use of weighted garments and related products offered for sale by Natural Resistance AB (the “Products”). Natural Resistance AB is a company incorporated under the laws of Sweden, with registered office at Ringduvegatan 6, 431 32 Mölndal, Sweden, company registration number 559462-9877, (hereinafter “Natural Resistance”, “we”, “us”, or “our”).

1.2 By accessing or using the Website, creating an account on the Website, or submitting an order for Products, the individual user or purchaser (the “Customer” or “you”) acknowledges and agrees to be legally bound by these Terms and Conditions in their entirety. Customers who do not accept these Terms and Conditions are not authorized to use the Website or to purchase Products from Natural Resistance.

1.3 Natural Resistance reserves the right, at any time and in its sole discretion, to amend, update, or otherwise modify these Terms and Conditions, without prejudice to the rights acquired by Customers prior to such modification. Any amendments will be published on the Website, together with the date of their entry into force. Customers will be notified of amendments by reasonable means, which may include electronic communication (such as email) or notice on the Website. Unless otherwise stated, amended Terms and Conditions shall apply prospectively from the date of their publication, and continued use of the Website or purchase of Products thereafter shall constitute acceptance of the amended Terms and Conditions.

1.4 These Terms and Conditions incorporate by reference the following documents, which are deemed to form an integral part hereof: (i) the Privacy Policy, which governs the processing of personal data; (ii) the Cookie Policy, which governs the use of cookies and similar technologies on the Website; (iii) the Refund Program Policy, which provides for a voluntary refund mechanism in addition to statutory withdrawal rights; and (iv) any other policies expressly referred to on the Website. Customers are required to review these policies carefully, as they contain important information about their rights and obligations.

2. Eligibility and Consumer Status

2.1 The Products available on the Website are intended exclusively for sale to consumers, meaning natural persons acting for purposes that are wholly or mainly outside their trade, business, craft, or profession, within the meaning of applicable European Union and national legislation. By placing an order for Products, the Customer represents and warrants that they are acting in their capacity as a consumer. Natural Resistance reserves the right to refuse, cancel, or restrict any order that it reasonably suspects is being placed by or on behalf of a business, reseller, distributor, or any other entity acting for commercial purposes.

2.2 By placing an order, the Customer further represents and warrants that they are at least eighteen (18) years of age and legally capable of entering into binding contracts under the laws of their country of residence. In cases where the Customer is under eighteen (18) years of age, the Customer affirms that they have obtained the express consent of a parent or legal guardian before accessing the Website or purchasing Products. Parents or guardians permitting minors to use the Website or to purchase Products acknowledge and agree that they are responsible for the actions, purchases, and compliance of the minor with these Terms and Conditions.

2.3 Nothing in these Terms and Conditions shall affect the statutory rights conferred upon consumers under applicable mandatory consumer protection legislation, including but not limited to Directive 2011/83/EU on consumer rights and Directive (EU) 2019/771 on the sale of goods.

3. Intellectual Property Rights

3.1 All intellectual property rights in and to the Website, the Products, and any content made available through the Website, including but not limited to copyrights, design rights, trademarks, trade names, logos, domain names, trade dress, graphics, images, product designs, text, audio-visual material, databases, source code, and software (collectively, the “Intellectual Property”), are and shall remain the sole and exclusive property of Natural Resistance AB or its licensors.

3.2 The Customer acknowledges and agrees that the purchase of Products or the use of the Website does not grant them any license, right, or interest in or to the Intellectual Property, other than a limited, revocable, non-exclusive license to access and use the Website for strictly personal and non-commercial purposes, in accordance with these Terms and Conditions.

3.3 Any reproduction, modification, adaptation, publication, distribution, transmission, republication, display, reverse engineering, creation of derivative works, or other exploitation of the Intellectual Property, in whole or in part, without the prior written consent of Natural Resistance, is strictly prohibited and constitutes an infringement of Natural Resistance’s rights. Natural Resistance reserves the right to take all necessary legal action, including seeking injunctive relief and damages, to protect its Intellectual Property against unauthorized use.

4. Use of the Website

4.1 The Customer undertakes to use the Website solely for legitimate purposes and in full compliance with these Terms and Conditions, as well as with all applicable laws, regulations, and generally accepted practices or guidelines in the relevant jurisdictions. The Website is made available exclusively for personal and non-commercial use, and any use of the Website for purposes other than those expressly permitted herein is strictly prohibited.

4.2 Without limitation, the Customer agrees not to engage in any of the following prohibited activities: (i) use of the Website in any manner that could interfere with, disrupt, impair, or adversely affect the normal operation of the Website or its underlying systems; (ii) the transmission, distribution, or introduction of viruses, trojans, worms, spyware, malware, or any other harmful or disruptive code; (iii) attempts to gain unauthorized access to the Website, to other Customer accounts, to Natural Resistance’s servers, or to any network or system connected to the Website; (iv) the use of automated systems, robots, crawlers, scrapers, or similar technologies to extract data from the Website for commercial or competitive purposes; (v) attempts to test the vulnerability of the Website or to circumvent or disable any of its security or authentication measures; or (vi) the use of the Website for any fraudulent, unlawful, defamatory, or otherwise harmful activity.

4.3 Natural Resistance reserves the right, at its sole discretion and without prior notice, to restrict, suspend, or permanently terminate the Customer’s access to the Website in the event of any violation of these Terms and Conditions, or in cases where Natural Resistance reasonably believes such action is necessary to protect the integrity of its systems, the rights of other Customers, or its own commercial interests. Natural Resistance also reserves the right to report any unlawful use of the Website to the competent authorities.

5. Accounts and Registration

5.1 In order to access certain functionalities of the Website or to place an order for Products, the Customer may be required to create a personal account (the “Account”). To create an Account, the Customer must provide accurate, current, and complete information as requested by Natural Resistance during the registration process. The Customer undertakes to maintain and promptly update such information to keep it accurate, current, and complete at all times.

5.2 The Customer is solely responsible for safeguarding the confidentiality of their Account credentials, including their username and password, and for restricting access to their devices to prevent unauthorized use of their Account. Any activity conducted under the Customer’s Account, whether authorized or unauthorized, shall be deemed to have been conducted by the Customer, who shall bear full responsibility for such activity.

5.3 If the Customer becomes aware of or reasonably suspects any unauthorized use of their Account or any other breach of security, they must immediately notify Natural Resistance. Natural Resistance disclaims all liability for losses or damages resulting from the Customer’s failure to comply with this obligation.

5.4 Natural Resistance reserves the right to suspend or close Accounts at its sole discretion if it reasonably suspects that the Account has been used for fraudulent purposes, in violation of these Terms and Conditions, or in a manner detrimental to Natural Resistance’s interests.

6. Products and Intended Use

6.1 The Products offered for sale by Natural Resistance include weighted garments such as vests, shirts, sports bras, arm sleeves, leg sleeves, and shorts. The Customer acknowledges and agrees that the precise specifications, weights, and features of each Product are described on the Website, and that such descriptions are provided for informational purposes only.

6.2 The Products are designed and manufactured exclusively for athletic training, fitness, and everyday wear. They are not designed, tested, or certified as medical devices, therapeutic equipment, or rehabilitation aids. Accordingly, the Products must not be used for the diagnosis, treatment, cure, or prevention of any disease, illness, injury, or medical condition. Any such use constitutes misuse of the Products and is undertaken entirely at the Customer’s own risk.

6.3 The Customer undertakes to use the Products strictly in accordance with the instructions, guidelines, and warnings supplied with each garment. Use of the Products outside the scope of these instructions, including but not limited to modification of the Products or combination with unauthorized accessories, shall constitute misuse and shall void any warranty provided by Natural Resistance.

6.4 Natural Resistance expressly disclaims any liability for damages, injuries, or losses arising out of or in connection with any misuse of the Products, failure to follow instructions, or use of the Products for purposes other than those expressly described.

7. Health and Safety Disclaimer

7.1 The Customer acknowledges that the use of weighted garments involves physical exertion and carries inherent risks, including but not limited to risks of muscle strain, joint stress, falls, cardiovascular events, or other injuries. By purchasing and using the Products, the Customer voluntarily assumes full responsibility for all such risks.

7.2 The Customer is solely responsible for assessing whether they are physically fit and capable of safely using the Products. Natural Resistance strongly recommends that Customers consult a physician or qualified healthcare professional before using the Products if they: (i) are under eighteen (18) years of age; (ii) are pregnant; (iii) suffer from cardiovascular, respiratory, or musculoskeletal conditions; or (iv) are recovering from injury, illness, or surgery.

7.3 Natural Resistance does not warrant or represent that the use of the Products will achieve any specific results, including but not limited to weight loss, improved strength, enhanced athletic performance, or recovery from injury. Any outcomes experienced by Customers are subjective and may vary significantly from person to person.

7.4 To the fullest extent permitted by applicable law, Natural Resistance disclaims all liability for injuries, health consequences, or damages of any kind resulting from the misuse of the Products, from failure to follow instructions or warnings, or from use of the Products beyond their intended purpose. Nothing in this clause shall exclude or limit liability for death or personal injury caused by Natural Resistance’s negligence or for fraud.

8. Ordering and Contract Formation

8.1 The presentation of Products on the Website shall not constitute a binding offer by Natural Resistance, but rather an invitation to the Customer to make an offer to purchase the Products.

8.2 By submitting an order through the Website, the Customer makes a binding offer to purchase the Products specified in the order under these Terms and Conditions.

8.3 The contract between Natural Resistance and the Customer shall be deemed concluded only when Natural Resistance accepts the Customer’s order by sending an order confirmation email. Until such confirmation is issued, no contract shall be deemed to exist, and Natural Resistance shall bear no liability towards the Customer.

8.4 Natural Resistance reserves the right, in its sole discretion, to refuse or cancel any order in whole or in part where it has legitimate reasons to do so, including but not limited to: (i) suspected fraud or abuse; (ii) suspected unauthorized resale or commercial use; (iii) unavailability of stock; (iv) errors in product descriptions or prices; or (v) inability to obtain payment authorization. In such cases, Natural Resistance shall notify the Customer and, where payment has already been made, issue a refund without undue delay.

9. Prices and Payments

9.1 The prices of the Products are those displayed on the Website at the time the Customer submits the order. All prices are indicated in the currency shown on the Website and include value added tax (“VAT”), where applicable, in accordance with applicable laws. Shipping costs, handling fees, and any additional charges, if applicable, shall be displayed separately prior to the Customer’s final confirmation of the order.

9.2 Natural Resistance takes reasonable care to ensure that all prices and information on the Website are accurate; however, errors may occur. If Natural Resistance discovers an error in the price of any Product after an order has been placed but before confirmation of the order, Natural Resistance will inform the Customer as soon as possible and give the option of reconfirming the order at the correct price or cancelling the order. If Natural Resistance is unable to contact the Customer, the order shall be deemed cancelled, and any amount already paid shall be refunded without undue delay.

9.3 Payment for Products must be made in full at the time of placing the order, using one of the payment methods available at checkout. Natural Resistance reserves the right to modify the accepted payment methods at any time. The Customer represents and warrants that they are authorized to use the payment method provided and that sufficient funds or credit are available to complete the transaction.

9.4 Payments are processed through secure third-party payment service providers. Natural Resistance disclaims liability for any errors, interruptions, or security breaches occurring within third-party payment systems, except where required by mandatory law.

10. Shipping and Delivery

10.1 Products ordered through the Website are delivered to the countries indicated during the checkout process. The list of eligible countries may be updated from time to time at Natural Resistance’s discretion. Orders placed for delivery to countries not available at checkout will not be accepted.

10.2 Estimated delivery times are provided on the Website for informational purposes only and shall not constitute binding commitments. While Natural Resistance strives to meet the indicated delivery times, delays may occur due to factors beyond its reasonable control, including but not limited to customs clearance, carrier delays, strikes, pandemics, or force majeure events. Natural Resistance shall not be liable for any damages arising from delivery delays, except where otherwise required by law.

10.3 Title to the Products and risk of loss shall pass to the Customer upon delivery of the Products to the address indicated in the order. Delivery shall be deemed completed upon the carrier’s confirmation of delivery.

10.4 If the Customer fails to accept delivery of the Products within the agreed timeframe, Natural Resistance may cancel the order, and the Customer shall bear the cost of return shipping and any associated expenses.

11. Right of Withdrawal and Returns

11.1 In accordance with Directive 2011/83/EU on consumer rights, the Customer has the right to withdraw from the purchase without giving any reason within thirty (30) calendar days from the date on which they, or a third party designated by them other than the carrier, physically received the Products.

11.2 To exercise the right of withdrawal, the Customer must notify Natural Resistance of their decision to withdraw before the expiry of the withdrawal period. Notification may be given by email or by using the standard withdrawal form available on the Website.

11.3 The Customer must return the Products to Natural Resistance without undue delay and in any event no later than fourteen (14) days from the date of notification of withdrawal. Products must be returned unused, in their original packaging, and with all original tags attached. For hygiene reasons, Natural Resistance will not accept returns of Products that show signs of wear, sweat, odor, damage, or other indications of use.

11.4 The Customer shall bear the direct cost of returning the Products. Initial delivery costs are non-refundable.

11.5 Natural Resistance shall refund the Customer the purchase price, excluding initial delivery costs, within fourteen (14) days of receiving the returned Products, using the same payment method used for the initial transaction, unless otherwise expressly agreed with the Customer.

11.6 Natural Resistance reserves the right to withhold the refund until it has received the Products back or until the Customer has supplied evidence of having sent back the Products, whichever is earlier.

12. Refund Program

12.1 In addition to the statutory withdrawal right described in Section 11, Natural Resistance offers a voluntary Refund Program, details of which are set forth in the Refund Program Policy available on the Website.

12.2 Under the Refund Program, Customers may return Products in good condition after the expiry of the statutory thirty (30) day withdrawal period and may be eligible to receive a partial refund. The amount of the refund and the conditions for eligibility shall be determined exclusively by Natural Resistance in accordance with the Refund Program Policy.

12.3 The Refund Program is provided at the sole discretion of Natural Resistance and may be amended, suspended, or withdrawn at any time without affecting the statutory rights of Customers.

13. Warranty and Defects

13.1 Products sold by Natural Resistance are covered by the statutory warranty of conformity provided under Directive (EU) 2019/771 and applicable national laws, which guarantees conformity of the Products with the contract of sale for a minimum period of two (2) years from delivery.

13.2 In addition, Natural Resistance offers a one (1) year limited commercial warranty covering defects in materials and workmanship. This warranty applies only to Products purchased directly from Natural Resistance through the Website.

13.3 The commercial warranty covers manufacturing defects such as faulty stitching, defective materials, or malfunctioning zippers and fastenings. It does not cover: (i) normal wear and tear; (ii) damage resulting from misuse, negligence, accidents, or failure to follow care instructions; (iii) unauthorized alterations or modifications; or (iv) purely cosmetic damage that does not affect the functionality of the Product.

13.4 In the event of a defect, the Customer shall promptly contact Natural Resistance customer service, providing proof of purchase and photographic evidence of the defect. Natural Resistance may, at its discretion, request the return of the defective Product for inspection.

13.5 Remedies available to the Customer under statutory warranty rights include repair, replacement, price reduction, or termination of the contract, depending on the circumstances and in accordance with applicable consumer protection laws. The Customer’s rights under mandatory law are not affected by the commercial warranty provided by Natural Resistance.

14. Force Majeure

14.1 Natural Resistance shall not be held liable or responsible for any failure or delay in performance of its obligations under these Terms and Conditions where such failure or delay results from events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, labor disputes, governmental actions, interruption of transport or telecommunications, or power failures (a “Force Majeure Event”).

14.2 In the event of a Force Majeure Event, Natural Resistance’s obligations shall be suspended for the duration of the event. Natural Resistance shall notify the Customer as soon as reasonably possible of the occurrence of a Force Majeure Event and of its expected impact on performance.

14.3 If the Force Majeure Event continues for a period exceeding thirty (30) days, either party shall have the right to terminate the contract by written notice, without liability for damages, provided that any amounts already paid for undelivered Products shall be refunded to the Customer.

15. Limitation of Liability

15.1 To the fullest extent permitted by law, Natural Resistance shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, business interruption, loss of data, or loss of opportunity, arising out of or in connection with the use of the Website, the purchase or use of the Products, or reliance on any information provided by Natural Resistance.

15.2 Natural Resistance shall not be liable for injuries, damages, or health consequences resulting from misuse of the Products, use contrary to instructions or warnings, failure to comply with applicable safety precautions, or reliance on unverified results or outcomes.

15.3 Nothing in these Terms and Conditions shall exclude or limit Natural Resistance’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be excluded under applicable law.

16. Governing Law and Dispute Resolution

16.1 These Terms and Conditions and any contractual or non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of Sweden, without prejudice to the mandatory rights granted to consumers under the laws of their country of residence.

16.2 The Customer shall first submit any dispute, complaint, or claim arising out of or in connection with these Terms and Conditions to Natural Resistance’s customer service team. Natural Resistance will make reasonable efforts to resolve disputes amicably.

16.3 If the dispute cannot be resolved directly with Natural Resistance, the Customer may submit their complaint through the European Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr. Natural Resistance is not obliged to participate in alternative dispute resolution procedures unless required by applicable law.

16.4 Unless otherwise required by mandatory consumer protection laws, any disputes arising out of or in connection with these Terms and Conditions shall fall under the exclusive jurisdiction of the competent courts of Sweden.

17. Miscellaneous

17.1 If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

17.2 These Terms and Conditions are drafted in the English language. In the event of any conflict or inconsistency between the English version and any translation, the English version shall prevail.

17.3 All notices, communications, and legal documents relating to these Terms and Conditions shall be provided in electronic form, either by email or by publication on the Website, unless otherwise required by mandatory law.

17.4 No failure or delay by Natural Resistance in exercising any right, remedy, or provision under these Terms and Conditions shall constitute a waiver of such right, remedy, or provision.
